Public Hearing for Downtown Zoning Change

NOTICE: At its regular meeting on September 19, 2012 at 7:00 p.m. prevailing time, Council for the Borough of West Chester, Chester County, Pennsylvania will hold a public hearing at Borough Hall, 401 East Gay Street, West Chester, Pennsylvania to consider the adoption of, and if approved, Borough Council will adopt an Ordinance amending Chapter 112 of the West Chester Borough Code, titled, “Zoning”. The title of the proposed Ordinance follows.

AN ORDINANCE OF THE BOROUGH OF WEST CHESTER, CHESTER COUNTY, PENNSYLVANIA, AMENDING THE BOROUGH OF WEST CHESTER ZONING ORDINANCE OF 1988, WHICH IS CODIFIED IN CHAPTER 112 OF THE CODE OF THE BOROUGH OF WEST CHESTER, TO CREATE A NEW HO-60 HEIGHT OPTION OVERLAY DISTRICT AND A NEW HO-75 HEIGHT OPTION OVERLAY DISTRICT AND TO ESTABLISH CONDITIONAL USE STANDARDS AND CRITERIA FOR SUCH OVERLAY DISTRICTS.  

A summary of the principal provisions of the Ordinance is as follows:
 
Section 1: Establishes the various zoning districts in the Borough; adopts the Zoning Map, Retail Overlay District Map, Height Option Overlay District Map, and Historic Carriage House Map; creates a new HO-60 Height Option Overlay District and identifies the parcels which will be included in such Overlay District; creates a new HO-75 Height Option Overlay District and identifies the parcels which will be included in such Overlay District; creates a Government Use Overlay District.

Section 2: Amends Section 112-30.1.C(1) to refer to the Height Option Overlay Districts.

Section 3: Amends Section 112-31 to refer to the HO-60 Overlay District.

Section 4: Amends Section 112-33.1 to establish conditional use standards which must be met for an applicant to build a building in the HO-60 Overlay District higher than 45 feet.

Section 5: Amends Section 112-36 to refer to the HO-75 Overlay.

Section 6: Amends Section 112-38.1 to establish conditional use standards which must be met for an applicant to build a building in the HO-75 Overlay District higher than 35 feet.

Section 7:  Severability Clause.

Section 8:  Repealer Clause.

Section 9: States that the Ordinance shall be effective upon enactment as law provides.

The full text of the Ordinance and Zoning Maps referred to and proposed to be adopted by the Ordinance are available for inspection without charge at the Borough of West Chester administrative offices, 401 East Gay Street, West Chester, Pennsylvania 19380, Monday through Friday from 8:30 a.m. to 5:00 p.m.  A copy of the full text of the Ordinance and Zoning Maps referred to and proposed to be adopted by the Ordinance may be obtained for a charge not greater than the cost thereof.  In addition, a certified copy of the proposed Ordinance and Zoning Maps referred to and proposed to be adopted by the Ordinance are also on file and available for inspection by members of the public at the offices of the Daily Local News, Bradford Avenue and Strasburg Road, West Chester, Pennsylvania, and the Chester County Law Library, Suite 2400 Chester County Justice Center, 201 W. Market Street, West Chester, Pennsylvania.
